Closet Envy Privacy Policy

Closet Envy LLC ("Closet Envy") is committed to respecting your privacy and protecting any personal information that you choose to share with us. As part of this commitment, we have posted this Privacy Policy ("Privacy Policy") to help you understand what information we may collect from you through the Closet Envy' website, at www.theclosetenvy.com, and through any mobile or touch applications (collectively, the "Site"), or offline, including by telephone and email, and how we handle that information. The Site is owned and operated by Closet Envy LLC, a Georgia limited liability company ("Closet Envy", "We", "Us"). This Privacy Policy applies to all users of our Site on or after the Effective Date. By using the Site, you signify your agreement and assent to our Privacy Policy. If you do not agree to the Privacy Policy, please do not register, subscribe, create an account, purchase products from the Site, or otherwise interact with Closet Envy at the Site.

Type of Information We Collect.

Traffic Data. We automatically track and collect the following information when you visit the Site: (i) IP address; (ii) domain server; (iii) type of computer; and (iv) type of web browser (collectively “Traffic Data”). Traffic Data is anonymous information that does not personally identify you but is helpful for marketing purposes or for improving your experience on the Site. We also use “cookies” to customize content specific to your interests, to ensure that you do not see the same advertisement repeatedly and to store your password so you do not have to re-enter it each time you visit the Site.

Personal Information. Personal information is defined as any information about an identifiable individual, including information that may be reasonably used to identify an individual, locate or contact an individual, for example, a first and last name, an email address, a home, postal or other physical address, telephone number, etc. In an effort to provide you with an efficient and pleasurable experience at the Site, Closet Envy may collect the following types of personal information and other information from you: (1) information which permits us to communicate with you, such as your first and last name, email address, home, postal or other physical address, telephone number, or fax number; (2) information that helps us understand what types of products interest you, e.g., your gender or affiliation with any company or organizations; (3) information which shows us how you interact on the Site, for example, which products you view and purchase; and (4) your financial account information such as your credit card number, the expiration date and card verification number, or other payment information, such as your debit card, or checking account information, as needed. We may also collect data through social media companies (such as Facebook or Twitter) subject to your granting permission in accordance with those company's information-sharing policies.

How We Collect Such Information.

Registration with the Site. Prior to using certain parts of the Site or placing an order with the Site, you must first register or create an account with the Site. During registration, Closet Envy will ask you to provide us with certain personal information, including your name, shipping and billing address(es), phone number, fax number, email address, credit card or debit card number or checking account information, and gender. This information is used by Closet Envy to place and fulfill your order, to communicate with you about your order, to facilitate the return of an item or to make an exchange and for internal marketing purposes. If you elect to use the Bill Me Later® payment method, you will be asked to provide us with your birth date and the last 4 numbers of your social security number. We will not store or keep this information in our files. This information will be used for the sole purpose to facilitate the Bill Me Later® transaction.

Voluntary Disclosure of Information. Certain areas of the Site provide you with the option to disclose your email address for certain purposes, including but not limited to: to subscribe to our newsletter; to receive information regarding special offers and promotions; to receive access to exclusive deals; to receive coupons; to receive information regarding new products, sizes or styles; or to register for a contest or sweepstakes. If you register for a contest or sweepstakes you may also be opting in to receive our email newsletter and special offers. This will be disclosed in the official rules governing the contest or sweepstakes. Also, if you register for a contest or sweepstakes, we will use the information that you have provided to us to contact you if you should win the contest and we may also post your name and geographic location on our Site. You may also be required to disclose your age in connection with the contest or sweepstakes registration.

Product Review. You may also choose to submit a product review with the Site. If you submit a review, we will ask you for your email address, your name (or your nickname), and your geographic location. Once you submit a product review, your name or nickname and your geographic location will be made public on the Site, as well as any personal information that you disclose in the content of the review.

Site Navigation. Closet Envy may also collect information from you when you use and navigate the site, e.g., information regarding the products you view and purchase.

Cookies and Tracking Technology. When you visit our Site, we collect certain information by means of technologies such as "cookies." A "cookie" is a piece of information that is transferred to your hard drive when you visit our Site, which automatically affiliates your browser to our server whenever you interact with our Site. A cookie cannot read data off your hard disk or read cookie files created by other websites. Closet Envy may use "cookie" technology to improve your online experience. Cookies allow us to recognize you when you return to the Site, and to track and target your interests. Closet Envy may also collect information using methods such as "refers," IP addresses, and environment variables. The environment variables Closet Envy gathers include time, the type of Web browser being used, the operating system/platform, and CPU speed. This information may be used in the aggregated form to monitor Site performance, use of features and traffic patterns, and browser version. We do not extract information about individual users or their computers during this process. We may monitor a visitor's use of the Site, and use or disclose any information gathered as part of our evaluation of the Site to satisfy any law, regulation or other government request, and to operate the Site properly and efficiently.

Most browsers are initially set to accept cookies but can be configured to refuse cookies or warn you before cookies are placed on your computer. If you refuse cookies, you may not be able to take full advantage of the Site. In particular, you may be required to accept cookies in order to complete certain actions on our Site, including the selection and placing of products into an online shopping cart and the ordering of such products. You do not need to have cookies turned on, however, to use our Site.

In most cases, the information we collect using cookies or other technologies is used in non-identifiable ways without reference to personal information. However, in the cases where we associate the information we collect using cookies and related technologies with your personal information, this Privacy Policy will control.

Log File Information. Log file information is automatically reported by your browser each time you access a web page. When you register with or view our site, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol ("IP") address, browser type, referring / exit pages and URLs, number of clicks, domain names, landing pages, pages viewed, and other such information.

Clear Gifs Information. When you use the Site, we may employ clear gifs (a.k.a. Web Beacons) which are used to track the online usage patterns of our users anonymously. No personally identifiable information from your Closet Envy account is collected using these clear gifs. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened by recipients. The information is used to enable more accurate reporting, improve the effectiveness of our marketing, and make the Site better for our users.

How We Use Your Information. Closet Envy may use your information to: (1) verify, process and track any orders of products that you place on the Closet Envy' Site; (2) contact you with questions or provide information to you regarding your order; (3) respond to your inquiries and provide customer support to you; (4) tailor your shopping experience to fit your specific needs; (5) develop and operate the Site; (6) improve the Site, the product selection and your experience at the Site; (7) with your consent, send you catalogues, promotional offers, advertisements and coupons that we believe may be of interest to you; (8) with your consent, provide you with information regarding Closet Envy that may be of interest to you, such as our newsletter and e-mail updates; (9) determine the types of products that may be of interest to you; and (10) oversee surveys, contests, sweepstakes or other activities or events sponsored by Closet Envy and to contact you regarding such activities with your consent. Please note that if you register with the Site or for a contest or sweepstakes, or otherwise submit your email to Closet Envy for the receipt of information (e.g., information regarding special offers, promotions, coupons, or new products, sizes or styles), we may send you an email to deliver the requested information, to provide you with information regarding your order, or to notify you as to the status of the contest or sweepstakes. You have the option to unsubscribe or opt-out of receiving communications from us at any time by following the instructions listed under the section entitled "Opt-Out."

We use the personal information you submit to operate, maintain, and provide to you the features and functionality of the Site.

We use Contact Data to send you information about the Site, our company or our products or services, or promotional material from some of our partners, or to contact you when necessary. We use your Financial Data to verify your qualifications for certain investments, rewards, products or services and to bill you for investments, rewards, products and services. We use your Demographic Data to customize and tailor your experience on the Site, displaying content that we think you might be interested in and according to your preferences.

In general, we will use the personal information you provide to:

1. identify you when you sign-in to your account;
2. enable us to provide you with products or services;
3. send you information we think you may find useful or which you have requested from us;
4. present projects to you when you use the Site which we believe will be of interest based on your geographic location and previous use of the Site;
5. administer your account with us;
6. enable us to contact you regarding any question you make through the Site;
7. analyze the use of the Site and the people visiting to improve our content and services; and
8. use for other purposes that we may disclose to you when we request your information.

We use cookies, clear gifs, and log file information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our service; (d) monitor aggregate metrics such as total number of visitors and traffic; (e) diagnose or fix technology problems reported by our users or engineers that are associated with the IP addresses controlled by a specific web company or ISP; and (f) help you efficiently access your information after you sign in.

Your personal information is never shared outside of Closet Envy without your permission, except Closet Envy may send your personal information to other companies or individuals in the following circumstances:

1. when we have your consent to share the information;
2. when we need to share your information to provide you with the products or service that you have requested, specifically (1) we may disclose your name, shipping address, email address, telephone number and fax number to third parties such as the U.S. Postal Service, Federal Express, or the United Parcel Service, so that they may ship and ensure delivery of products to you or so that we may measure and improve the quality of the service of the third party; and (2) we may also disclose your financial information to credit card processers or issuers in order to facilitate the payment and processing of purchase made on the Site;
3. when we need to send your information to companies who work on behalf of Closet Envy to provide a service to you (we will only provide those companies the information they need to deliver the service, and they are prohibited from using that information for any other purpose);
4. if required or advised to do so by law;
5. to prevent or mitigate a fraud or credit risk;
6. to affect a proposed or actual sale (including a liquidation, realization, foreclosure or repossession), merger, amalgamation, transfer, exchange or other disposition (whether of assets, shares or otherwise) of all or a portion of our business in order for you to continue to receive the same products and services from the third party;
7. to protect and defend our rights, property, and this Site; or
8. to act in urgent circumstances to protect personal safety or the public.

You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms that we use to collect your data. Opt-Out. By providing us your email address you consent to our using the email address to send you Site-related notices, including any notices required by law, in lieu of communication by postal mail. You may not opt out of some Site-related communications. However, you can change the frequency of many Site-related communications by emailing us at admin@theclosetenvy.com. We may also use your email address to send you other messages, including changes to features of the Site and special offers. If you do not want to receive such email messages, you may opt out by emailing us at admin@theclosetenvy.com. Opting out may prevent you from receiving email messages regarding updates, improvements, or offers.

Data Security. Closet Envy takes commercially reasonable efforts to protect the security of the information you send to us with physical, electronic, and managerial procedures. Specifically, Closet Envy uses firewalls, encryption technology and cryptographic protocols to provide security over the Internet, and Secure Sockets Layer (SSL) for all financial transactions conducted on the Site. Although we strive to protect your personal information, we cannot ensure the security of the information that you transmit to us, and encourage you to take every precaution to protect your personal information when you are on the Internet.

We may use certain information about you and/or your User Content without identifying you as an individual to third parties. We do this for purposes such as analyzing how the Site is used, diagnosing service or technical problems, maintaining security, and personalizing advertisements and promotions.

We reserve the right, but have no obligation, to monitor the User Content you post on the site. We have the right to remove any such information or material for any reason or no reason, including without limitation, if in our sole opinion, such information or material violates, or may violate, any applicable law or our Terms of Use agreement or to protect or defend its rights or property or those of any third party. We also reserve the right to remove information upon the request of any third party.

Children's Privacy. We are concerned about the safety of children when they use the Internet. We want you and your family to be safe while visiting our Site. We do not knowingly request personally identifiable information from any child. We urge parents to regularly monitor and supervise their child's online activities. No one under the age of 13 should submit any personal information to us without the consent of a parent or guardian. Sharing of Personal Information. Persons under eighteen (18) years of age (or the legal age to enter into contracts in your jurisdiction, of older) are not permitted to use the Site, and so this privacy policy makes no provision for their use of the Site.

Information that you submit through the Site may be transferred to countries outside the United States to provide products and services to you. If we transfer your information outside the U.S. in this way, we will take steps to ensure that your privacy rights continue to be protected.

We share Demographic Data with advertisers and other third parties only on an aggregate basis. We may share Contact Data with other companies who may want to send you information about their products or services. We may store personal information in locations outside the direct control of Closet Envy (for instance, on servers or databases co-located with hosting providers).

As we develop our business, we may buy or sell assets or stock of other companies. Customer, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer such information in the course of corporate divestitures, mergers, or dissolution. In any such transfer of information, your user information would remain subject to this Privacy Policy.

Except as otherwise described in this Privacy Policy, we will not disclose personal information to any third party unless required to do so by law or subpoena or if we believe that such action is necessary to (a) conform to the law, comply with legal process served on us or our affiliates, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to enforce our Terms of Use, take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our site; and (c) to exercise or protect the rights, property, or personal safety of Closet Envy, our users or others.

We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested third parties to help them understand the usage patterns for our Sites.

We allow other companies, called third-party ad servers or ad networks, to serve advertisements on the Site. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on the Site. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content.

We do not provide any personally identifiable information to these third-party ad servers or ad networks without your consent. However, please note that if an advertiser asks us to show an advertisement to a certain audience and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience they are trying to reach.

You should consult the respective privacy policies of these third-party ad servers or ad networks. Our privacy policy does not apply to, and we cannot control the activities of, such advertisers.

The Site utilizes the services of a number of third-parties to perform certain key functions of the Site, including receipt of disbursement of all funds related to purchases on the Site, and other matters. The Site will disclose your Personal Information to these third-parties in order to facilitate the Site and you consent to all such disclosures.

We may disclose your Personal Information to:

1. our affiliated companies;
2. non-affiliated third parties that perform services, such as marketing or market research, on our behalf (e.g., we may provide your name, address, phone number, or e-mail address to vendors that send our e-mail or regular mail);

5. non-affiliated third parties at your direction or for which you have provided your express consent; and
6. third parties in connection with the proposed or actual financing, insuring, sale, securitization, assignment or other disposal of all or part of our business or assets (including accounts) for the purposes of evaluating and performing the proposed transaction.

We require that commercial entities (as described above) with which we share your Personal Information agree to keep your information confidential. We also prohibit those entities from using or disclosing your information except for a limited purpose and to the persons for whom disclosure was intended, or as otherwise permitted or required by law. Service providers to whom we disclose personal information must agree to contractual requirements consistent with our privacy and security policies. We prohibit our service providers from using personal information except for the specific purpose for which we provide it to them, and require them to comply with legal obligations applicable to the personal information at issue.

Generally, the Personal Information that we collect from you will be stored in the United States and other countries, which may have different privacy laws and standards than those in your country of residence. Your personal information may be transferred to or processed in the United States by us or a third-party service provider working for us, or for one of our affiliates or suppliers. By submitting Personal Information via our website or other means, you agree to such storage, transfers and processing. We will take all steps reasonably necessary to treat your Personal Information securely and in accordance with this Privacy Policy.

It is important to note that some or all of your Personal Information provided to third-party service providers may be held in countries other than your own, including in particular the United States. You acknowledge and understand that your Personal Information will be subject to the applicable laws of each such jurisdiction, which may not provide for the same protection as your country of residence. Confidentiality and Security of Personal Information. Except as otherwise provided in this Privacy Policy, we will keep your Personal Information private and will not share it with third parties, unless such disclosure is necessary to: (a) comply with a court order or other legal process; (b) protect our rights or property; or (c) enforce our Terms of Use. Your Personal Information is stored on secure servers that are not accessible by third parties. We provide you with the capability to transmit your Personal Information via secured and encrypted channels if you use a similarly equipped web browser.

We use commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to us and you do so at your own risk. To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from Closet Envy, at all times.

Compromise of Personal Information. In the event that personal information is compromised as a result of a breach of security, we will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy, or as otherwise required by applicable law.

Third Party Sites. This Privacy Policy addresses only the use and disclosure of information by Closet Envy. The Site may contain links to websites operated and maintained by third parties, over which we have no control. Privacy policies on such linked sites may be different from our Privacy Policy. Closet Envy does not maintain any responsibility for information given to third parties. Should you be asked for information on a site, whether it be through a banner or another link on the site, we strongly recommend you read the privacy policy at that site before providing any information to the site or taking advantage of any offer or promotion.

Interactive Areas. Our Site may contain discussion forums, bulletin boards, discussion groups, chat rooms or other forums, in which you and third parties may publish, post, and obtain access to various kinds of information on the Site ("Interactive Areas"). Prior to using the Interactive Areas, please read the Terms of Use carefully. The information that you submit to the Interactive Areas is public and accessible over the Internet, such that any personal information you include may be viewed and accessed by others. Any personal information or content that you voluntarily disclose in public areas of the Site becomes publicly available and can be collected and used by other users. You should exercise caution before disclosing your personal information through these public venues.

Access to Your Information. We will be happy to review, update or remove your information as appropriate.

Cookies. Cookies are small pieces of information which are issued to your computer when you visit a website and which store and sometimes track information about your use of the Site. We use cookies to help recognize you as a repeat visitor, to improve the quality of our Site, and to try and make your browsing experience meaningful. When you enter our Site, our web server sends a cookie to your computer which allows us to recognize your computer but not specifically who is using it. By associating the identification numbers in the cookies with other customer information when, for example, you log-in to the Site, then we know that the cookie information relates to you. Closet Envy retains your personal information for as long as necessary to fulfill the purpose(s) for which it was collected and to comply with applicable laws, and your consent to such purposes(s) remains valid after termination of our relationship with you.

Notification Procedures. It is our policy to provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to you via email notice, written or hard copy notice, or through conspicuous posting of such notice on our Site page, as determined by us in our sole discretion. We reserve the right to determine the form and means of providing notifications you, provided that you may opt out of certain means of notification as described in this Privacy Policy.

California Residents. California Civil Code §§ 1798.83–1798.84 gives California residents the right to request information from us which describes the categories of personal information that we share with affiliated companies or third parties for direct marketing purposes. If you are a California resident and would like a copy of this information, please submit a written request to the email or mailing address displayed at the end of these Terms.

Changes to this Privacy Policy. We reserve the right, at any time and without notice, to add to, change, update or modify this Privacy Policy, simply by posting such change, update or modification on the Site. Any such change, update or modification will be effective immediately upon posting on the Site. We encourage you to periodically review this Privacy Policy in order to keep apprised of our current privacy practices. If we make material changes to this policy, or in how we use or collect your personally identifiable information, we will prominently post such changes prior to implementing the change. We will not make any retroactive material changes in how we handle previously collected personal information unless you allow us to do so, or unless we are legally required to do so, and in such a case we will email registered Site visitors information on retroactive material changes to this Privacy Policy.
